Resolving the Details That Make an Agreement Work
Some assets also call for work beyond the settlement agreement itself. For example, dividing certain retirement benefits may require a separate order to carry out the terms the spouses have agreed upon. A home or other real estate can involve additional documents to properly transfer or clarify ownership.
This can be particularly important for couples with significant retirement accounts, military benefits, stock-based compensation, or real estate holdings. Reaching an agreement about an asset and completing the legal steps necessary to implement that agreement are not always the same thing.
When parents have minor children, custody issues need to be resolved. Saying that both parents will “share custody” does not provide much guidance when questions arise about school schedules, weekends, holidays, exchanges, or important decisions affecting a child.
