Quick Facts

Abuse does not have to be physical violence!  It can be as simple as disturbing your peace, as long as you have a reasonable fear due to the behavior exhibited.

California Family Code Section 6320 defines abuse as any of the following:

  1. Intentionally or recklessly cause or attempt to cause bodily injury
  2. Sexual assault
  3. Placing a person in reasonable apprehension of imminent serious bodily injury to that person or to another
  4. Engaging in any behavior that has or could be stopped such stalking, harassing, impersonating, or threatening

The National Coalition Against Domestic Violence defines domestic violence as violent or aggressive behavior within the home, typically involving the violent abuse of a spouse or partner. This can include:

  • Threatened or actual physical violence
  • Threatened or actual sexual violence
  • Emotional & psychological abuse (e.g., name calling, threats to “out” a person’s sexual orientation to family, put-downs, etc.)
  • Stalking (e.g., excessive phone calling/texting/emailing, monitoring daily activities or using technology to track a person’s location)
  • Financial abuse (e.g., withholding owed money, ruining credit, stopping a partner from getting or keeping a job)
