The San Diego Family Court Modification Process

As divorce modification attorneys, we assess the current case, organize supporting information, and address the procedural requirements for requesting or opposing a change. The path may vary based on the type of order, whether the parties agree, and whether immediate relief is requested.

The general California process may include:

  • Reviewing the order: Confirm the current judgment, case number, and precise terms at issue.
  • Preparing the request: Form FL-300, Request for Order, is generally used to ask the court to make or change orders in an existing family law case.
  • Filing and service: File the required forms and arrange legally proper service on the other party.
  • Attending mediation when applicable: A custody or parenting-time matter may involve mediation or child custody recommending counseling before the hearing.
  • Presenting the matter: Attend the scheduled hearing with the facts and evidence relevant to the request or response.

If the parties agree on revised terms, they may ask the judge to approve their agreement instead of proceeding through a contested hearing. Until the court approves a change, the current order generally remains in effect.
